Following the Biagi Law (Legislative Decree 276/2003 art. 6 and art 4) it has been recognized in Italy the HR Consultants Foundation, as subject granting for the control of the activities of its associated members. Through direct authorization of the Italian Ministry of Labour and attorney to the HR Consultants Foundation, all associated consultants will be legally allowed, in derogation to the companies procedures of authorization, to act in the research, recruitment and selection business area, plus consulting for employment and self employment contracts start up, also through the use of the National Data Bank of the Ministry of Labour, to which the access is reserved only to authorized subjects. About 3 year have then been necessary to have a clear work procedure track from the same Foundation, and during 2006 the real activity has finally been starting.

Such activities have bee delegated with this procedure, also in consideration of the activity that already several HR Consultants were supplying on the labour market. At the end of February 2006 about 3,55% of the about 21.370 Italian chartered HR Consultants have been registered with the opportunity to supply this service, probably due to the quite new legislation but also for real difficulties of an efficient service organization in case of entities of small size.

It will anyway remain legally right only of the consultants registered as chartered psychologists, to act for psychological attitude tests and evaluations, in order to obtain proper reports of compliance of the candidates individual skills with the required profiles.

Employers which should decide to act for such evaluations without the support of a work psychologist (especially for not selected candidates), would risk the possible request of claim from candidates which should feel their selection and evaluation process not properly completed (Milan Law Court notice n. 5688 of the 28th of May 2003).

The service for Italy has therefore been organized on name of Luca Martin, as HR Consultant associated to the Foundation, and includes the combination and integration of the services described below, rendered respectively from the two kind of consultants described above, allowed to supply the indicated activities.

The two sections of the service agreement proposal have therefore been indicated with different descriptions as follows, remaining the same related to separated but integrated professional support :
